These Terms of Use (hereinafter “Terms”) aim to define the terms and conditions for providing and using the services of the PeacoPix website, accessible at: https://peacopix.com.

1. Legal Notice

The PeacoPix website is published by a private individual residing in France, acting in a personal capacity. Website hosting and domain name management details can be found on the site’s Legal Notice page.

2. Service Description

PeacoPix is a free and unlimited online tool allowing users to remove backgrounds, recenter, modify, convert, and ensure compliance of image batches specifically designed for marketplaces (Amazon, Etsy, eBay, AliExpress, etc.) and e-commerce platforms.

3. Data Processing and Image Confidentiality (Trade Secret)

• 100% Local Processing (Client-Side): All image processing, including the use of artificial intelligence for background removal, is performed exclusively locally within the User’s web browser (via WebAssembly).
• Trade Secret Guaranteed: No images, files, or data related to uploaded images are transmitted, sent, stored, or saved on external servers, databases, or third-party APIs. The trade secret of the User’s products (notably prototypes or future launches) is thus fully guaranteed.
• Automatic Deletion: Files are kept temporarily in the local RAM of the User’s browser. They are immediately and permanently deleted as soon as the User closes the page or refreshes their browser.

4. Terms of Use and Technical Limits

To ensure tool stability within the browser and prevent RAM overloads, the User agrees to comply with the technical limitations set by the Publisher:

• Maximum number of files per batch: 50 images simultaneously.
• Maximum file size: 20 MB per image.
• Sequential Processing: Images submitted in batches are processed one after the other (queue system) to preserve the hardware capabilities of the User’s machine.
• AI Performance Optimization: In order to combine execution speed with high definition, images are temporarily resized (to 1024 pixels) for local AI background removal analysis. The generated clipping mask is then reapplied to the original image to preserve 100% of the initial quality and resolution.

The Publisher reserves the right to adjust or modify these limits at any time without prior notice.

5. Intellectual Property and Content Responsibility

1. Image Rights: The User guarantees that they hold all intellectual property rights, licenses, or necessary authorizations for the images they process via PeacoPix.
2. Compliant Use: The User refrains from submitting for processing any images containing illicit, defamatory, counterfeit elements, or infringing on the privacy of a third party.
3. Lack of Control: As processing is performed strictly locally, the Publisher has no access to nor any control over the content of processed files. The User remains solely and exclusively responsible for the images they transform and the use they make of them on marketplaces.

6. Limitation and Exclusion of Liability

1. Service Guarantee: The PeacoPix service is provided on an “as is” and “as available” basis. The Publisher does not guarantee that the service will be uninterrupted, error-free, or bug-free.
2. AI Background Removal Quality and Compliance: The Publisher makes every effort to provide a high-performing tool for compliance and AI background removal. However, the Publisher does not guarantee perfect background removal results in 100% of cases, as this depends on the complexity, contrast, and lighting of the original image. Furthermore, although the “presets” are designed to comply with market standards, the Publisher cannot guarantee that the final images will be systematically accepted by the validation algorithms of different marketplaces.
3. Data Loss: The Publisher cannot be held liable for any potential file loss, image deterioration, browser malfunctions, or technical incompatibilities occurring during tool use. It is the User’s responsibility to keep an original copy of their files.
4. User Performance and Hardware: As image and AI processing take place locally via the browser, the execution speed and service performance depend exclusively on the technical capabilities, computing power (CPU/RAM), and the condition of the device used by the User. The Publisher cannot be held liable for slow processing, browser crashes, or a degraded user experience due to insufficient hardware resources.

7. Advertising and Cookies

In order to keep the service free and sustainable, PeacoPix may display advertisements provided by third-party ad networks (such as Google AdSense or any other partner network).

These ad networks may use cookies and similar technologies to personalize or measure ad delivery. A consent management mechanism (cookie banner / CMP) is made available to the User in accordance with applicable regulations (GDPR), allowing them to accept, reject, or configure the placement of these cookies at any time.

8. Service Availability

The Publisher reserves the right to modify, suspend, interrupt, or terminate access to the PeacoPix website, temporarily or permanently, for maintenance, updates, or any other reason, without prior notice or compensation to Users.

9. Translation and Language

These Terms of Use are originally written in French. If the website or these Terms are translated into one or more other languages, only the French version shall prevail in the event of a dispute, ambiguity, or challenge regarding the interpretation of a clause.

10. Applicable Law and Jurisdiction

These Terms of Use are subject to French law. In the event of a dispute or litigation arising from the use of the site, and failing an amicable resolution, French courts shall have exclusive jurisdiction.
